These are the standing terms that govern every engagement with Delightful Site — what each side is responsible for, how work is paid for and delivered, who owns what at handoff, and what happens when something goes sideways.

These are the working terms that govern engagements with Delightful Site while a more comprehensive Terms of Service is being finalized. They cover the essentials — who we are, how we work, payment terms, basic intellectual property rules, and dispute resolution.
A fuller Terms of Service will replace this version once it has been reviewed by counsel. Engagements that begin under these working terms will continue under the terms in effect at the time of original signup.

Delightful Site ("DS") is a web design and development practice based in Aurora, Colorado. DS designs, builds, and (where contracted) hosts websites for US-based clients across two product lines: pre-built Shop listings and bespoke custom work.

These working terms apply to every engagement with Delightful Site, including Shop sales, Hosted subscriptions, Custom Render commissions, custom work, and à la carte add-on services. By engaging Delightful Site for any service, you agree to these terms.
For Shop sales, à la carte add-ons, Custom Render commissions, and Maintenance Plans, agreement is confirmed by checkbox at checkout. For Hosted subscriptions, agreement is confirmed at the initial setup-fee checkout. For custom work, these terms are incorporated by reference into the Statement of Work signed at project start.
Delightful Site serves US-based clients only. All pricing is in US Dollars and billed via Stripe in USD. Clients must have a US-based business or billing address.
We do not take on projects in adult content, gambling, cryptocurrency or NFT projects, multi-level marketing, or any industry we judge to be misleading or harmful.
Delightful Site reserves the right to decline any project for any reason.
For Shop sales: visit delightfulsite.com/shop, submit the Try It On form for the listing you've chosen, and complete checkout once we've confirmed fit. We'll begin the build immediately after payment.
For custom work: submit the custom inquiry form on our site. We'll respond within 48 hours, and if it's a fit, schedule a free 30–45 minute discovery call. After the call, we send a written proposal within one week. The project begins once you sign the Statement of Work and pay the 50% deposit.
For Custom Render commissions: available only to clients with a planned or active Delightful Site engagement.
Email is our primary communication channel. We don't conduct project work via phone, text, social DMs, or real-time chat platforms unless specifically arranged in writing.
Current pricing is documented in our published pricing for each product. Specific amounts referenced here are illustrative; published pricing controls.
We accept payment via Stripe Checkout. Buy Now Pay Later (BNPL) via Stripe Affirm or equivalent may be available for one-time purchases (Shop Handoff, Design License purchase, custom work payments, Custom Render commissions, à la carte add-ons). BNPL is not available on recurring subscription charges.
We do not transfer ownership of repositories, hosting accounts, or domains until payment is complete. We do not deploy add-on work to live sites until the add-on is paid. Standard practice — paid work is delivered, unpaid work is not.
For recurring subscriptions: if a payment fails, Stripe retries automatically. After 7 days of unsuccessful retries we may suspend the service until payment is current. After 30 days of non-payment we may terminate the engagement.
For one-time payments more than 14 days late, we may suspend further work and refer to dispute resolution. Late payments accrue interest at 1% per month or the legal maximum, whichever is lower.
If you have a concern about an engagement, please contact us first at hello@delightfulsite.com. We would much rather discuss a problem and reach a resolution than defend a chargeback. Initiating a chargeback without first attempting good-faith communication is a breach of these working terms.
The general principle: creative work, once performed, is non-refundable. Refunds and partial refunds apply in specific situations.

When you purchase Handoff, complete a custom work project, or convert a Hosted subscription to ownership through a Design License purchase, you receive ownership of:
You may modify the deployed site freely for your own business and may host it elsewhere or hand it to another developer if you choose.
Ownership transfer specifically excludes:
Across every engagement, Delightful Site retains:
Custom Render commissions grant you broad commercial use of the rendered output for any business purpose related to the company that commissioned the render — your website, social media, paid advertising, print materials, email marketing, and similar uses.
You may not resell the render, sublicense it to other businesses, transfer it to another company without our written agreement, or use it for unrelated business ventures. Source files for Custom Renders are not included.
If you have a Hosted subscription, you are licensed to use the site as part of the subscription. You may not download, scrape, mirror, or copy the site code, assets, or design for use outside our hosting environment. The Design License purchase mechanism exists for clients who want their site; that's the legal path to ownership.

We commit to:
If direct communication doesn't resolve a dispute within 30 days, either party may request mediation through a mutually agreed mediator in Aurora or Denver, Colorado, with costs split equally between the parties.
We reserve the right to terminate any engagement immediately, without refund, if a client engages in harassment, threats, or abuse during a dispute.
We warranty that sites delivered will function as agreed for 30 days post-launch. During this warranty period, we will fix bugs (defects in delivered work, not feature requests or design changes) at no additional cost.
Our total liability for any claim arising from an engagement is limited to the total amount you paid Delightful Site in the 12 months preceding the claim. We are not liable for incidental, consequential, special, or punitive damages, lost profits, lost business opportunity, lost revenue, or lost goodwill.
This limitation applies to the maximum extent permitted by Colorado law.
If DS plans to wind down operations, active Hosted clients receive 90 days' notice and are offered the option to purchase the Design License at standard tier pricing (regardless of tenure threshold) to take ownership of their site.
If unexpected circumstances prevent us from continuing service, we maintain documentation sufficient to honor active commitments where reasonably possible, and active subscription clients can cancel without penalty with refund of any pre-paid months not yet served.
These working terms are governed by the laws of the State of Colorado. Any dispute that proceeds to litigation will be brought in state or federal courts located in Arapahoe County or Denver County, Colorado.
If any provision of these terms is found unenforceable, that provision is severed and the remaining terms continue in effect.
We may update these working terms while a fuller Terms of Service is being finalized. Material changes will be communicated to active subscription clients with 30 days' notice. The current version of these terms is always at delightfulsite.com/terms.
